Black Wealth Events takes the security and proper handling of your data seriously. However, it’s important to understand the extent of our responsibility and the limits of our liability regarding data. This Data Liability Statement outlines what we do to protect your information and clarifies circumstances under which we cannot be held liable for data issues. By using our services, you acknowledge and agree to the following:
Our Commitment to Data Security
We implement reasonable security measures to protect the personal data you share with us. These measures include the use of encryption (such as SSL/TLS for website traffic), access controls to restrict data to authorized personnel, and secure data storage practices. We also require our third-party service providers to adhere to best practices in security. For instance, payment information is processed by Stripe, which is PCI-DSS compliant and has its own stringent security protocols, and data on the NetWurk.ai platform is protected under their security measures.
We periodically review our security procedures to guard against vulnerabilities and update our practices in line with evolving standards. In the unfortunate event of a data breach or security incident, we have procedures in place to notify affected users and authorities as required by law (for example, many U.S. states have breach notification laws with which we will comply).
No Absolute Guarantee
Despite our best efforts, no method of data transmission or storage is completely secure. Cyber threats and unforeseen vulnerabilities can, in rare instances, lead to unauthorized access or disclosure of data. Black Wealth Events cannot guarantee absolute security of your information. By providing your data, you understand that there is always some risk involved in transmitting information over the internet or storing it on servers, and you agree not to hold us liable for breaches that occur despite the implementation of reasonable safeguards.
Use of Third-Party Tools and Services
We utilize several third-party services to deliver our offerings (as described in our Privacy Policy and Cookie Policy). These include, but are not limited to: NetWurk.ai (for CRM, networking, or marketing automation), Stripe (for payment processing), Google Analytics (for site analytics), and possibly others for email communication or event management. While we carefully select these providers and aim to use reputable, industry-leading companies with strong security track records, we do not have direct control over their systems. Therefore:
- Third-Party Responsibility: Each third-party service is responsible for protecting the data within its own systems. We cannot be held liable for any data breach, exposure, or misuse that occurs on the part of a third-party provider. For example, if Stripe were to experience a security incident that compromises credit card data, Stripe would bear responsibility for that incident under their agreements and applicable laws. Black Wealth Events would coordinate with Stripe and communicate to affected users as needed, but we are not financially or legally liable for damages caused by Stripe’s security failures.
- Data Sharing with Third Parties: We share only the necessary information with service providers to perform their functions (e.g., we send your payment details to Stripe to process a payment, or your name and email to NetWurk.ai to send you an event invitation). These providers are contractually obligated to use the data only for our purposes and to protect it. However, if a third party misuses your data beyond the scope of our agreement (for example, if a provider accessed your information for unauthorized reasons), that conduct is outside our control. We would take appropriate action (such as terminating the relationship and reporting the misuse), but we cannot guarantee prevention of such acts nor assume liability for them.
- Review Policies: We encourage users to review the privacy and security policies of key third-party services we use. Understanding their practices can give you additional assurance of how your data is treated. If you have specific concerns about a particular service (e.g., “How does NetWurk.ai secure my information?”), we will do our best to provide you with or direct you to those details.
User Responsibilities
Maintaining the security of your data is also partly your responsibility. We urge users to take appropriate steps on their end:
- Account Security: If you create an account with us, choose a strong, unique password and keep it confidential. Do not share your login credentials with others. Black Wealth Events is not liable for data exposure or account misuse resulting from your failure to secure your own account information. If someone gains access to your account because you left a device unattended or fell victim to a phishing attack, that is beyond our ability to control.
- Device and Network Security: Be mindful of how you access our services. Using public or unsecured Wi-Fi networks can increase risk. Ensure your devices have up-to-date antivirus software and that you practice safe browsing habits. We cannot protect data that is compromised before it reaches our systems or after it leaves our systems (for example, if malware on your computer hijacks data as you input it).
- Accurate Information: Provide accurate information and promptly inform us if you suspect any unauthorized activity related to your data or account. If you suspect someone has unauthorized access to your account or personal information related to Black Wealth Events, notify us immediately so we can assist in securing your account and investigating.
Limited Liability for Data Issues
To the maximum extent permitted by law, Black Wealth Events limits its liability in matters related to data security and privacy as follows:
- We are not liable for any indirect, incidental, special, or consequential damages that may result from unauthorized access to, or alteration, disclosure, or destruction of, your data. This includes any loss of profit, loss of business, emotional distress, or other intangible losses you might suffer in connection with a data incident.
- In any event, our total liability for direct damages (if we are found legally responsible despite the above protections) is limited as described in our Terms of Use & Service – generally capped at the amount you have paid us for services, or $100 if no payments were made, whichever is greater. This cap includes claims related to data breaches or privacy violations.
- These limitations apply even if we have been advised of the possibility of such damages, and they apply to all causes of action, whether arising from breach of contract, tort (including negligence), or any other legal theory.
Acknowledgement
By using Black Wealth Events’ services and providing your personal information, you acknowledge that you understand and agree to this allocation of risk. You agree that Black Wealth Events has provided services at a price (which may be free for site access or a fee for event tickets) that reflects this Data Liability Statement, and that we could not feasibly offer our services without such limitations. If you do not agree with these terms, please refrain from using our services or contact us to discuss any concerns.
Ongoing Efforts
We will continue to update our security measures as technology and threats evolve. This Data Liability Statement may also be updated from time to time to clarify our practices or reflect changes in our approach to data security. If we make significant changes, we will notify users through our website or other appropriate means.
